SugarBear Contest Rules and Regulations

The following are basic rules governing the contest conducted by SugarBear. No purchase is necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning. In the event that no other rules are published for a particular contest or promotion, the following rules will apply. In some instances, rules for individual contests and promotions may conflict with these rules in which case, the individual contest rules will take precedence over the basic rules. All contests are void where prohibited by law.

Agreement to Rules and Regulations. Participation in a SugarBear contest constitutes participant’s full and unconditional agreement to and acceptance of these Contest rules. Winning a prize is contingent upon being compliant with these Rules and Regulations, and fulfilling all other requirements set forth herein.

Prize(s). The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash or exchangeable for any other prize. Participants must provide valid and accurate contact information. If a winner cannot be contacted or is disqualified for any reason, SugarBear reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion. 

Eligibility and Limitations. Participants can enter more than once. Participants must be over the age of 13. A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but SugarBear reserves the right to refuse to award a prize to or on behalf of any minor. 

Sponsor. The Contest is sponsored by SugarBear. This Contest is not sponsored by TikTok, Instagram, or Facebook. The promotion is in no way sponsored, endorsed or administered by, or associated with TikTok, Instagram, or Facebook.  Each entrant or participant agrees to complete release of TikTok, Instagram, and Facebook as they are not part of this contest and they bare no liability.

Contest Period. The Contest begins on August 25, 2020 at 9:00 am EST and ends on September 01, 2020 at 11:59 pm EST (the Contest Period). Entries that are submitted before or after the Contest Period will be disqualified. 

Entries. Only entries submitted on TikTok using the designated sound by SugarBear may be used to enter the contest. Winners will be selected from all eligible entries received during the Contest Period. 

Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant SugarBear exclusive permission to use their names, characters, photographs, voices, videotape, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. 

Release. By participating in the contest, each participant and winner waives any and all claims of liability against SugarBear, its employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by SugarBear.

Winner Notification. The potential winners will be notified on TikTok. SugarBear will contact potential winners and ask them to provide a contact email. Once the potential winner supply’s this information SugarBear will contact them via email. Each potential winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, SugarBear reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, SugarBear will award the applicable prize to an alternate winner by drawing from among all remaining eligible entries. 

Misinformation. SugarBear is not responsible for undeliverable, lost, delayed, misdirected or misaddressed email or any other issues regarding the electronic delivery of emails. This includes, but is not limited to, the speed at which your email service routes email through the internet. The sole determiner of eligibility will be the time the email or Declaration of Compliance is received at our offices.

Conduct and Decisions. By participating in the contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. SugarBear will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and SugarBear’s decisions concerning such disputes shall be final. If the conduct or outcome of the contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of SugarBear, SugarBear reserves the right to terminate this contest, or make such other decisions regarding the outcome as SugarBear deems appropriate. SugarBear may waive any of these rules in its sole discretion. Any attempt by an entrant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this contest is a violation of criminal and civil laws. Should such an attempt be made, SugarBear reserves the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law. 

Miscellaneous. Void where prohibited. Odds of winning depend upon the number of participants. Each winner must submit proof of eligibility and sign SugarBear’s release form to claim the prize. SugarBear may substitute prizes, amend the rules or discontinue the contest at any time as announced. SugarBear disclaims any responsibility to notify participants of any aspect related to the conduct of the contest. All entries become the property of SugarBear and will not be returned. 

Compliance with Law.  The conduct of the contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. SugarBear shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the contest, etc. as required by local and state law.
